Gilbert Rugby Competition Terms and Conditions

Introduction

1. These terms and conditions are the Competition rules (the "Rules") that apply to all "Gilbert Rugby" managed and administered Competitions (the "Competition"). A copy of these Rules will be posted on the Gilbert Rugby website at www.gilbertrugby.com

2. The Rules apply to the Competition that is promoted by Gilbert Rugby and by entering the competition, the entrant agrees to be bound by the Rules. Gilbert Rugby reserves the right to cancel the Competition or to amend these Rules at any time without notice. Notification of cancellation or any amendment(s) will be posted on the Gilbert Rugby Website. It is the responsibility of entrants to keep themselves informed of any changes to the Rules.

3. In the event of unforeseen circumstances that render the Competition itself or the awarding of the prize/s impossible, Gilbert Rugby may at its absolute discretion vary or amend the Competition; and the entrant agrees that no liability shall attach to Gilbert Rugby as a result thereof.

4. Any queries about the Competition or these Rules should be directed in writing to: Competitions, Gilbert Rugby, Station Road, Robertsbridge, East Sussex TN32 5DH.

5. In the event of any dispute regarding these Rules or otherwise relating to the Competition, the decision of Gilbert Rugby shall be final and unchallengeable and no correspondence or discussion shall be entered into, comment issued, or reason given in respect of any decision made. Competition Entrants

6. By entering the competition, the entrant warrants that all information submitted is true, accurate and complete in every respect. Gilbert Rugby reserves the right to verify the eligibility of any Entrant. Gilbert Rugby further reserves the right to disqualify any Entrant if, in the opinion of Gilbert Rugby, such Entrant has breached any of these Rules or otherwise acted improperly or dishonestly.

7. Unless otherwise stated, the Competition is only open to persons who are resident in the United Kingdom and persons who are resident outside of the United Kingdom may not apply.

8. The Competition is open to all UK residents aged 18 or over, except for employees of Grays International and its subsidiary companies and any other individual associated to the specific competition, their families or anyone else who is professionally associated with the competition. Gilbert Rugby reserves the right to disqualify any person that it knows is, or has reasonable grounds to believe is, ineligible for the Competition as a result of this Rule.

9. In the event that a Prize-Winner is disqualified from the Competition, an alternative Prize Winner in the same manner as the original Prize-Winner will be selected subject to the Rules. Competition Entries

10. Entries must be made between 00:01am on the 25th December 2015 and 11:59pm on the 24th March 2016 (the "Entry Period"). Outside of the Entry Period, no entries to the Competition will be permitted. Gilbert Rugby will not accept responsibility for failing to receive any entry during the Entry Period as a result of a delay or failure in delivery, transmission or otherwise (howsoever caused).

11. Each entrant will only have one qualifying entry per Competition.

12. The tie-breaker shall be used when two or more entrants choose the same player. The nearest to the correct total in the tie-breaker will be declared the winner. If entrants still cannot be separated a draw will take place between the remaining entrants. Prize Winners

13. Prize-winners will be selected and notified in the manner set out in the Competition Terms. No prize will be awarded where any entrant has committed any form of misconduct (as determined by Gilbert Rugby in its sole discretion).

14. Where Entries are judged on artistic or other subjective criteria, Gilbert Rugby reserves the right to set amend the criteria used to judge Entries. Prizes are non-transferable and there is no cash alternative. In the event of a prize being unavailable for any reason Gilbert Rugby reserve the right to substitute prizes of equal or greater value at any time.

15. Prizes must be accepted in the manner set out in the Prize Notification. In the event that any Prize Notification is returned as undeliverable or any Prize-winner fails to validly reply to a Prize Notification within 28 days, Gilbert Rugby reserves the right to disqualify the Prize-winner and select an alternative Prize-winner.

16. Any prize will be awarded to the first valid entry drawn at random by an independent, supervised individual. The decision is final and no correspondence will be entered into by Gilbert Rugby in relation to that decision.

17. Prizes are awarded at Gilbert Rugby discretion and no prize will be awarded to any Entrant who, in the opinion of Gilbert Rugby, has breached any of these Rules or otherwise acted improperly or dishonestly.

18. Any match ticket which forms part or all of any prize shall be provided to the prize winner for use strictly subject to the terms and conditions of such ticket. Liability

19. Gilbert Rugby accepts no responsibility for any damage, loss or injury or disappointment of any kind suffered by an Entrant as a result of entering the Competition (including as a result of any entrant winning the prize) or accepting any prize (to the extent such liability can be excluded).

20. Gilbert Rugby accepts no responsibility for Entries lost, damaged or delayed or due to computer error in transit. Intellectual Property Rights and Collection of Data

21. Each entrant confirms that their entry is original and that they have the right to licence to Gilbert Rugby the copyright and the intellectual property rights in the Entry for the purposes referred to in the Rules. Ownership will remain with the entrant, but Gilbert Rugby shall reserve the right to use, reproduce, publish, display, transmit, copy, amend, store and sub-licence such right to its sponsors, partners and other relevant third parties.

22. Each Entrant hereby unconditionally agrees to:
(a) the use of their name, one or more photographs of themselves and disclosure of their town/city of residence on the Gilbert Rugby website and any Gilbert Rugby owned and administered Social media account and
(b) co-operate with or participate in any other reasonable post-Competition publicity.

23. Each Entrant, by entering the Competition, consents to the processing of his/her personal data by Gilbert Rugby for the operation of the Competition and as otherwise provided for pursuant to these Rules.

24. Gilbert Rugby will use the personal information and contact details provided by or obtained about an Entrant for administering the Competition and to ensure compliance with these Rules.

25. Any personal data relating to Entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the Entrant's prior consent.

26. Entrants have the right to receive a copy of the personal data that Gilbert Rugby holds about them (a fee will be payable) and to correct any inaccuracies in their personal data.

Governing Law and Jurisdiction

The Rules and any dispute or claim arising out of or in connection with them or their subject matter (including the Competition), existence, negotiation, validity, termination or enforceability shall be governed by and construed in accordance with English law. Entrants submit to the exclusive jurisdiction of the English courts.
